$24K ethics fine levied against ex-San Francisco planning commissioner

Former San Francisco Planning Commissioner Frank Fung agreed to be fined $24,200 for violating multiple city ethics rules at a hearing on Friday.

A stipulation agreement brought by the San Francisco Ethics Commission found that Fung's architectural firm, ED2 International, entered into a subcontract with the city's Airport Commission in 2021 while he served as a city official. ED2 International received $39,460 from the city as part of the subcontract agreement.

Fung was a planning commissioner from May 2019 to June 2022.

Fung also failed to report large sources of income he received as an owner of the architectural firm while he was a planning commissioner, according to the stipulation agreement.

Fung admitted he "made a mistake" and misunderstood San Francisco's laws on the extent his company could be involved in public work, he told The Standard.

If the Ethics Commission approves the agreement put forward by commission staff on Friday, Fung could be fined $20,000 for entering a contract agreement with the city while holding a governmental position and $4,200 for his failures to disclose income.
