The man who allegedly attacked Nancy Pelosi’s husband with a hammer appeared in federal court in San Francisco on Wednesday, where a judge set his next hearing for Feb. 8, according to court filings.

David DePape appeared before U.S. District Court Judge Jacqueline Scott Corley beside his Federal Public Defender Angela Chuang, who will now be handling the case alongside Federal Public Defender Jodi Linker.

DePape has been charged with the attempted kidnapping of a federal officer or employee and with the assault of an immediate family member of a federal official. He has pleaded not guilty to both.

DePape also faces state charges, and his attorney appeared in San Francisco Superior Court earlier this week.

Prosecutors say that DePape broke into the Pelosi home on Oct. 28 and struck Paul Pelosi in the head with a hammer. Police officers say they witnessed the attack after responding to an emergency call at the residence. DePape allegedly tried to kill Mr. Pelosi and planned to kidnap the speaker of the House as part of a one man “suicide mission.”
